1. Agreement
These Terms of Use (“Terms”) apply to the Handpick app for iPhone and iPad (“Handpick” or “the app”), developed by Benjamin Zhuang (“we” or “us”). By downloading or using Handpick, you agree to these Terms.
Your license to use Handpick is granted under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms add details specific to Handpick. If these Terms and the Standard EULA conflict, the Standard EULA controls.
2. Your photos
You keep all rights to your photos, videos, and albums. Handpick reads and organizes them on your device so it can show, sort, and clean up your library. We do not receive, store, or claim any rights to your content. Our Privacy Policy explains exactly what the app accesses.
3. Deleting photos
Handpick never deletes anything without your confirmation. Photos you mark for deletion wait in the app’s Trash until you confirm, and iOS asks you to confirm again before removing them. Deleted items then move to the Recently Deleted album in Apple Photos, where iOS keeps them for about 30 days before removing them for good.
You are responsible for the items you choose to delete. Features such as Duplicates, Clutter first, and Large Files are suggestions to help you decide, and they can be wrong. Review each item before you confirm, and keep a backup of any photos you cannot afford to lose.
4. Handpick Plus
Handpick is free to use. Handpick Plus unlocks extra features and is offered as a weekly or annual auto-renewing subscription, or as a one-time lifetime purchase. Prices are shown in the app before you buy and may vary by region.
Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically at the same price and length unless you cancel it at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your Apple Account settings. If you cancel, Plus stays active until the end of the period you have paid for.
If a free trial is offered, any unused part of it ends when you purchase a subscription. A lifetime purchase is a single payment and does not renew.
All purchases are processed by Apple, and Apple’s terms apply to them. We cannot issue refunds directly. To request one, visit reportaproblem.apple.com.
5. Acceptable use
Use Handpick only for lawful purposes and in line with the Standard EULA. Do not copy, modify, or redistribute the app, bypass its purchase checks, or try to extract its source code, except where the law allows it.
6. Changes to the app
We may update Handpick to add, change, or remove features. Some updates may be required to keep using the app. We may also stop offering Handpick, in which case any active subscription will not renew.
7. Disclaimer
Handpick is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the app will be error-free or uninterrupted, or that it will find every duplicate or large file in your library.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, including photos or videos you choose to delete. Our total liability for any claim relating to Handpick is limited to the amount you paid for Handpick Plus in the 12 months before the claim.
Some jurisdictions do not allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived by contract.
9. Ending these Terms
You can stop using Handpick at any time by deleting it from your device. Your rights under these Terms end automatically if you break them. Sections 3, 7, 8, and 10 continue to apply after these Terms end.
10. Governing law
The governing law and venue provisions of the Standard EULA apply to these Terms.
11. Changes to these Terms
We may update these Terms as Handpick changes. The effective date at the top of this page shows the current version. If you keep using Handpick after an update, the new Terms apply.
